Divorce

Whether you are considering filing for divorce, or have already been served with divorce papers, it is important to contact a divorce lawyer who can help you understand your rights, and explain the divorce process to you. UNCONTESTED DIVORCE

Not every divorce is adversarial. In some situations, a couple is able to come to an agreement on the division of marital property and debt, the restoration of nonmarital and premarital property, and issues relating to their children. If a couple is able to reach an agreement on their own, uncontested divorce may be right for them. In an uncontested divorce, while not representing both parties, the attorney prepares all of the documents for both parties, based on their agreement.

CONTESTED DIVORCE

There are many factors in every divorce, and the specific issues will be different between every couple. Understanding your case and how the law applies are key factors in minimizing litigation costs and achieving the best outcome. Contested divorces may be resolved through alternative dispute resolution, such as settlement negotiations or mediation, or by a Judge. CHILD CUSTODY

Legal custody can be joint custody or sole custody. While there is a presumption of joint custody, the Courts can grant sole custody to one parent based on the circumstances. The ultimate determination of custody is made in accordance with the child's best interest.

When the parents of a child do not reside together, the parties need to set a parenting time schedule to ensure that both parents will be able to spend time with the child. In many cases, one parent may be obligated to pay child support to the other parent. 

PRENUPTIAL AGREEMENTS

Once considered a rarity, reserved only for the rich and famous, prenuptial agreements have become increasingly popular in recent years among couples of all ages and income levels. Prenuptial agreements allow couples entering into marriage to clearly establish the assets and debts held by each party at the time of the marriage and decide how the division of assets and debts will be handled in the event of divorce or death. 

Prenuptial agreements are a form of contract that allows the parties to personalize their agreement to reflect their specific intentions. A prenuptial agreement can be drafted to address issues beyond the protection of property owned by the parties at the time of marriage. Based on the needs and the wishes of the parties, prenuptial agreements can address characterization of property and debt acquired after the date of marriage, potential maintenance obligations in the event of divorce, and rights to property in the event of death.
